OFFICIAL RULES FOR THE “Y GEN CARES AT THE HOLIDAYS” CONTEST
NO PURCHASE, PAYMENT, OR DONATION OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A DONATION WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The “Y Gen Cares at the Holidays” Contest (“Contest”) begins at 12:00:00 AM Central Time (“CT”) on December 13, 2010, and ends at 11:59:59 PM CT on January 3, 2011 (“Contest Entry Period”).
By entering this Contest, entrants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification. All decisions of the judges regarding this Contest are final and binding in all respects.
ELIGIBILITY: This Contest is only open to legal residents of the 50 United States and District of Columbia who are between the ages of 18 and 30 years old as of the date of entry. Employees, agents, officers and directors of Y Gen Out Loud (“Sponsor”), Offers.com (together with Sponsor, the “Contest Entities”), and promotional partners (including American Eagle Outfitters) or any other party associated with the development or administration of this Contest, their respective parents, affiliates, subsidiaries, franchisees, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling or spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Contest. This Contest is void outside the 50 United States and the District of Columbia, and where prohibited.
HOW TO ENTER: Entries must be received during the Contest Entry Period. Entries received after the Contest Entry Period are void and ineligible for consideration by judges.
Essay: To enter, submit an original essay describing what you are doing this holiday season to give back to your community, whether local, national or global. Include the name of the nonprofit, charity, or cause you support, and explain why you feel it’s important to be a volunteer.
Limit one entry per person. Essays must be submitted in English at a maximum of 500 words, typed in the body of an e-mail (do not send as an attachment). Send the e-mail to contest@ygenoutloud.com. Also be sure to include your name, age, birth date, mailing and e-mail addresses, and phone numbers (home, work, cell) in the body of the e-mail.
Essays exceeding 500 words or sent as an attachment will not be considered. Sponsor is not responsible for lost, late, or incomplete entries; or entries not received for any reason. Entries will not be acknowledged or returned. Please keep a copy of your entire submission as Y Gen Out Loud will not reproduce your submission for purposes of providing a copy to you.
Video: To enter, submit a video response to the “Y Gen Cares at the Holidays” Call for Entries video on YouTube at http://www.youtube.com/user/YGenOutLoud.
The original video, no longer than 3 minutes in length, should describe what you are doing this holiday season to give back to your community, whether local, national or global. Include the name of the nonprofit, charity, or cause you support, and explain why you feel it’s important to be a volunteer.

All videos must be submitted via YouTube. If you are not an existing user of YouTube, you will be required to create a free user account at http://www.youtube.com/signup. Registration on YouTube must be completed before the video can be submitted or considered for the Contest. When you register your YouTube account, you will be required to agree to the YouTube Terms of Use and the YouTube Privacy Policy.
Slideshow: To enter, submit a response to the “Y Gen Cares at the Holidays” Call for Entries video on YouTube at http://www.youtube.com/user/YGenOutLoud.
The original slideshow must not exceed 3 minutes in length and include only photographs and audio (no video allowed). Show what you are doing this holiday season to give back to your community, whether local, national or global. Include the name of the nonprofit, charity, or cause you support, and explain why you feel it’s important to be a volunteer.
Limit one entry per person. Along with posting the slideshow on YouTube, you must send an e-mail with your name, age, birth date, mailing and e-mail addresses, and phone numbers (home, work, cell) to contest@ygenoutloud.com.

All slideshows must be submitted via YouTube. If you are not an existing user of YouTube, you will be required to create a free user account at http://www.youtube.com/signup. Registration on YouTube must be completed before the slideshow can be submitted or considered for the Contest. When you register your YouTube account, you will be required to agree to the YouTube Terms of Use and the YouTube Privacy Policy.
Once you submit your own original essay, video, or slideshow, you will be officially entered into the Contest. Contest entries cannot be revised or altered once submitted. By your submission, you represent and warrant that they are your own original creation, you own all the rights to the submitted materials, you have acquired permission from all other persons who may appear in the submitted materials, the submissions do not contain illegal, dangerous, or unsafe activity, do not disparage competitors, do not involve drug or alcohol use, are intended for family audience viewing, and have not been copied in whole or in part from any other work and do not violate or infringe any copyright, trademark or other proprietary right of any person or entity (including any rights of privacy or publicity). Sponsor has the sole and unfettered discretion to determine whether submissions are suitable for all persons over the age of 13, are sexually explicit, disparaging, libelous or otherwise inappropriate; promote any product or services of competitors; and contain copyrighted work. Sponsor in its sole discretion may decide to disqualify the entry. Once submitted, the essay, video, or slideshow becomes the exclusive property of the Contest Entities and will not be returned. By entering, you grant Y Gen Out Loud and anyone it may authorize permission to display your essay, video, or slideshow and biographical information on ygenoutloud.com. Winners agree to allow the use of his/her names, likeness, and/or voice in publicity or advertising concerning this promotion without compensation. No photocopies, facsimiles, or other mechanical reproductions of entries are allowed. Altered, defaced, mutilated, illegible, or incomplete entries are ineligible. Entrant agrees and acknowledges Sponsor may have access to material that is similar or identical to Contest Material and that the entrant may not be entitled to any compensation for any use of Sponsor of this similar material.
As a condition of entry, Contest entrants irrevocably grant to Sponsor, Contest Entities, promotional partners and their affiliates, legal representatives, assigns, agents and licensees a worldwide, royalty-free, non-exclusive, sublicensable, unconditional, perpetual and transferable right and license to:
* Reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation, as to when or to the number of times used), the entrant’s submitted name, address, image, likeness, statements, biographical material in contest promotions.
* Use the Contest Entry Materials for advertising, promotion or commercial purposes and the right, without limitation, to publicly display, reproduce and distribute the Contest Entry Materials in any media format or medium and through any media channel.
* Allow access to material via RSS or any similar feed.
* Forfeit rights of privacy, intellectual property rights or other legal or moral rights that would preclude Sponsor or affiliates from using the Contest Entry Material for promotional purposes and agrees to never sue or assert any claim against the Contest Entities’ and promotional partners’ use of those Materials.
The Contest Entities shall have the right to disqualify any entries that they deem to be obscene, vulgar, sexually explicit, lewd, derogatory, inappropriate, or otherwise not in good taste, as determined by the Contest Entities in their sole discretion. Essays, videos, or slideshows must be 100% your original work.
PRIVACY POLICY: Any personal information supplied by entrant to YouTube will be subject to YouTube’s privacy policy posted at http://www.youtube.com/t/privacy.
JUDGING: Entries will be judged by representatives of Y Gen Out Loud, Offers.com, and American Eagle Outfitters, based on the following criteria: originality, creativity, use of language/video/photography skills, and appropriateness to contest theme. Incomplete and/or inaccurate entries and entries not complying with all rules are subject to disqualification. Decisions of judges are final and binding. Winners will be notified by telephone and/or e-mail on or about January 17, 2011.
CONTEST PRIZES: One Winner will be announced from each of the three categories. Each Winner will be awarded one (1) $250 Visa Gift Card. The winning Essay, Video, and Slideshow as well as any Honorable Mentions will be featured on the Y Gen Out Loud website. Each winner also will appear as a guest on the radio show “Keeping Up with Gen Y” on the WomensRadio Network at a time to be determined by the Sponsor.
PRIZE CLAIMS: Winners will be selected on or about January 14, 2011, and will be contacted by telephone and/or e-mail on or about January 17, 2011. The winners will also be announced the week of January 17, 2011, on the Y Gen Out Loud website at http://ygenoutloud.com. In the event that a Winner is unable or unwilling to accept a Prize, an alternate Winner will be selected. Prior to delivery of any Prize, winners will be required to complete and sign an Affidavit of Eligibility and Liability Release, and, where legal, a Publicity Release, all of which must be returned within 30 days of attempted prize notification or the Prize will be forfeited and awarded to an alternate winner. Sponsor may also require that any person(s) shown in the video and slideshow also execute a release or other confirmation of consent to such appearance in, and display or distribution of, the video and slideshow. If the Prize is won by an eligible person who is not of legal age in the state of residence, the prize shall be awarded in the name of the Winner’s parent or legal guardian, who must sign and return all required documentation prior to receiving the Prize. In the event of noncompliance with these Rules, or if a Prize or prize notification is unclaimed or returned as undeliverable, the Prize will be forfeited and may be awarded to an alternate winner.
Prizes are not transferable. No substitution of Prizes is permitted except at the sole discretion of the Sponsor.
GENERAL CONDITIONS: The Contest Entities are not responsible for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software or web site. The Contest Entities are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Contest, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, the Entities reserve the right to terminate entrant’s eligibility to participate in the Contest. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and, should such an attempt be made, the Contest Entities reserve the right to seek damages from any such person to the fullest extent permitted by law. The Contest Entities’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Contest Entities reserve the right to terminate, cancel, suspend and/or modify the Contest if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by any of the Contest Entities in its sole discretion. In such event, the Contest Entities reserve the right to award the prize to the entrant whose submission has received the highest average and most number of ratings at the time of the impairment. Only the stated number of prizes will be awarded. In no event will more prizes be awarded than those listed under “CONTEST PRIZES.” In the event of a dispute as to the identity of an online entrant, the online entry in question will be deemed submitted by the authorized account holder of the e-mail. The authorized account holder shall be the natural person to whom the applicable e-mail address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A Potential Winner may be requested to provide the Sponsor with proof that the Potential Winner is the authorized account holder of the e-mail address associated with the winning entry.
By entering the Contest and/or accepting the prize, entrants/prize winners agree to: (a) be bound by these rules; (b) release the Contest Entities, promotional partners, their parent companies, or organizations, subsidiaries, affiliates, advertising and promotion partners, fulfillment and/or judging agencies, agents and their estate and/or family members from all liability, claims, action, or proceedings relating to the Contest and from injuries or damages arising in connection with or relating to participation in the Contest, or use or misuse of the prize; and (c) waive any right to claim ambiguity in the Contest or these Official Rules. By accepting the prize, winner further acknowledges that the Sponsor and any other entity involved with this Contest have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to the prize or prize suppliers or to any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose including, without limitation, use of any equipment associated with the prize. All taxes and other expenses not specified herein, including federal, state, local, and departure, licenses and registrations, are the sole responsibility of the winner. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest, to void suspect entries and/or cancel, terminate or suspend any portion of this Contest should a virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Contest and, in any such event, at its discretion, select winners from eligible, non-suspect entries received prior to the event requiring such termination, cancellation or suspension.
Contest Entities are not responsible for typographical or other errors in the offer or administration of this contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of winners, or the distribution of any prize.
All entries become the property of Y Gen Out Loud and will not be acknowledged or returned. Contest Entities and each of their officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, sponsors, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance or use of any prize, or from participation in this contest.
The “Y Gen Cares at the Holidays” Contest is not endorsed or affiliated with YouTube. YouTube has no responsibility or liability regarding the conduct or administration of the contest.
TAX INFORMATION: All federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner.
DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Contest Entities and promotional partners in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Texas. Entrant agrees to indemnify Contest Entities and promotional partners for all claims brought by third parties in connection with Contest Entry Material.
